These Terms of Service (“Terms”) govern your use of the Meliora Wellbeing website, digital content, workshops, webinars, speaking engagements, educational programs, resources, and other services offered by Meliora Wellbeing (“Meliora,” “we,” “us,” or “our”).

By accessing this website, registering for or purchasing an offering, downloading or using our materials, or participating in a Meliora Wellbeing service, you agree to these Terms.

If a specific program, event, speaking engagement, organizational contract, registration page, or purchase agreement contains additional or different terms, those specific terms will apply to that offering. Where there is a conflict, the more specific written agreement will govern.

1. About Meliora Wellbeing

Meliora Wellbeing provides education, speaking, facilitation, workshops, webinars, digital learning resources, and related wellbeing services.

Our work may address topics including wellbeing, stress, sustainable practice, burnout and vicarious trauma, breath and self-regulation, Life Promotion, land-based approaches, identity, community, leadership, and other health and wellbeing topics.

Offerings may be provided online, in person, individually, to groups, or through third-party organizations.

2. Educational Services — Not Individual Medical Care

Unless expressly stated otherwise in a separate written agreement, Meliora Wellbeing services and content are provided for educational and informational purposes.

Information provided through this website, presentations, workshops, webinars, digital products, resources, social media, or other educational activities is not individualized medical advice, diagnosis, treatment, psychotherapy, emergency care, or a substitute for care from an appropriate healthcare professional.

Ber Roberts' professional nursing background and credentials inform aspects of Meliora Wellbeing's work. However, participation in a Meliora Wellbeing educational service does not, by itself, establish a nurse-client, healthcare-provider/patient, therapist-client, or other clinical relationship.

If Meliora Wellbeing separately provides a regulated professional service, that service may be subject to additional professional standards, informed-consent requirements, documentation requirements, or terms specific to that service.

If you have questions about your individual physical or mental health, medications, symptoms, diagnosis, treatment, or ability to participate safely in an activity, seek advice from an appropriate regulated healthcare professional.

If you are experiencing a medical or mental health emergency, contact emergency services or an appropriate emergency/crisis service in your area.

3. Your Participation and Responsibility

Participation in Meliora Wellbeing offerings is voluntary.

You are responsible for deciding whether an activity, exercise, discussion, practice, suggestion, or resource is appropriate for you and for modifying or stopping your participation when necessary.

No specific health, business, professional, personal, financial, or other outcome is promised or guaranteed.

4. Respectful and Inclusive Participation

Meliora Wellbeing is committed to creating learning environments that are respectful, inclusive, and psychologically safer for participants.

Harassment, discrimination, threats, intimidation, abuse, deliberate disruption, or behaviour that creates an unsafe environment for participants, facilitators, staff, contractors, or others will not be tolerated.

Meliora Wellbeing may take reasonable steps to address inappropriate behaviour, including limiting participation or removing a person from an event, program, online space, or service.

Where participation is terminated because of serious misconduct, eligibility for a refund will depend on the circumstances, the applicable cancellation/refund policy, any written agreement, and applicable law.

Where there is an immediate safety concern or legal obligation, Meliora Wellbeing may contact appropriate authorities or emergency services.

5. Fees, Payments and Taxes

Prices, payment terms, applicable taxes, currency, and any additional charges will be identified on the applicable registration, product, proposal, invoice, contract, or checkout page.

Unless otherwise stated, prices are in Canadian dollars.

Applicable taxes, including GST where required, will be added or identified as appropriate.

Payments may be processed using third-party payment providers. Meliora Wellbeing does not necessarily receive or retain your complete payment-card information.

For organizational speaking engagements, workshops, consulting, facilitation, or customized services, the payment terms in the applicable proposal, agreement, or invoice will govern.

6. Cancellations, Refunds and Rescheduling

Cancellation and refund terms may vary depending on the type of offering.

The cancellation or refund policy displayed on the applicable product page, registration page, proposal, invoice, or written agreement forms part of these Terms.

Digital Products

Unless otherwise stated at purchase, digital products, downloadable materials, recorded programs, and other immediately accessible digital content are generally non-refundable once access or delivery has occurred, subject to any rights available to you under applicable law.

Live Public Workshops and Events

Cancellation, transfer, and refund terms for live public workshops and events will be identified during registration.

If Meliora Wellbeing cancels an event, participants will generally be offered a refund, credit, rescheduled date, or other reasonable remedy appropriate to the circumstances.

Organizational Bookings

Speaking engagements, private workshops, facilitation, consulting, and organizational services may have separate cancellation, rescheduling, travel, deposit, and refund provisions contained in the applicable written agreement or proposal.

Nothing in these Terms removes rights or remedies that cannot legally be excluded under applicable consumer-protection legislation.

7. Digital Products and Access

When you purchase or receive access to a Meliora Wellbeing digital product, course, recording, webinar, resource, workbook, or other protected material, you receive a limited, personal, non-exclusive, non-transferable licence to use that material for its intended purpose.

8. Intellectual Property

Unless otherwise stated, Meliora Wellbeing or the applicable creator owns the intellectual-property rights in materials made available through our website and services.

You may use materials provided to you for your own personal or authorized internal use, subject to any additional licence terms supplied with the material.

Organizations wishing to reproduce, distribute, adapt, record, license, or reuse Meliora Wellbeing materials must obtain prior written permission unless such use is expressly included in a written agreement.

9. Recording, Photography and Media

You may not record, photograph, livestream, reproduce, or distribute a Meliora Wellbeing presentation, workshop, webinar, or facilitated session unless permission has been provided.

Meliora Wellbeing will provide notice where we intend to record or photograph an event for our own purposes. Additional consent may be requested where appropriate.

At conferences or events hosted by another organization, that organization's recording, photography, privacy, or media policies may also apply.

10. Website Use

You may use this website for lawful personal, professional, and informational purposes.

Meliora Wellbeing collects, uses, stores, and discloses personal information in accordance with our Privacy Policy and applicable privacy law.

Our Privacy Policy describes the types of information we collect, why we collect it, how it may be used or disclosed, the service providers involved, and how you may contact us regarding your personal information.

The Privacy Policy forms part of these Terms.

13. Email Communications

If you voluntarily subscribe to Meliora Wellbeing email updates, we may send you information about workshops, events, learning opportunities, resources, or related Meliora Wellbeing activities.

You may unsubscribe from marketing emails using the unsubscribe mechanism provided in the message.

Administrative emails required to complete a purchase, deliver a service, respond to an inquiry, or communicate important information about an existing registration or transaction are separate from optional marketing communications.

14. Disclaimer of Warranties

Meliora Wellbeing makes reasonable efforts to provide accurate, useful, and current information.

However, educational and website content is provided on an “as available” basis. To the extent permitted by law, we do not warrant that all website content or educational information will always be complete, error-free, uninterrupted, current, or suitable for every individual or circumstance.

Health, professional, scientific, legal, technological, and other information may change over time.

You should obtain appropriate individualized professional advice before acting on information where your particular circumstances require it.

15. Limitation of Liability

To the maximum extent permitted by law, Meliora Wellbeing and its directors, officers, employees, contractors, facilitators, and agents will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from use of the website, educational content, or services.

Where liability cannot legally be excluded, Meliora Wellbeing's liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms excludes, limits, or waives a right, remedy, warranty, condition, or liability that cannot lawfully be excluded or limited.

To the extent permitted by law, you agree to be responsible for losses, claims, or reasonable costs arising directly from:

17. Events Outside Our Reasonable Control

Meliora Wellbeing will not be responsible for delay or failure to provide an offering caused by circumstances reasonably outside our control, which may include severe weather, wildfire, natural disaster, illness, public-health restrictions, travel disruption, telecommunications outages, power failures, labour disruption, government action, or failure of a critical third-party service.

Where such circumstances affect a paid service, we will make reasonable efforts to reschedule, provide an alternative, issue a credit or refund where appropriate, or otherwise address the situation in accordance with the applicable agreement and law.

Organizations engaging Meliora Wellbeing for speaking, workshops, facilitation, consulting, licensing, customized programs, or other professional services may enter into a separate proposal, service agreement, purchase order, or contract.

19. Changes to These Terms

Meliora Wellbeing may update these Terms when our services, business practices, technologies, or legal requirements change.

The current version will be posted on our website with the date of the most recent update.

Changes will apply prospectively unless applicable law requires otherwise.

20. Governing Law

These Terms are governed by the laws of the Province of Alberta and the applicable federal laws of Canada.

Subject to any rights or remedies that applicable legislation provides otherwise, disputes concerning these Terms will be subject to the jurisdiction of the courts of Alberta.

21. Severability and Waiver

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

A failure by Meliora Wellbeing to enforce a provision on one occasion does not waive our right to enforce that provision later.

22. Entire Agreement

These Terms, together with the Privacy Policy and any applicable registration terms, refund policy, product terms, proposal, or written service agreement, constitute the agreement applicable to your use of the relevant Meliora Wellbeing service.
